Welcome to 8Creatives. These Terms & Conditions (“Terms”) describe our Design Desks and creative services. Your accepted quotation or signed service agreement confirms the specific scope, billing period, payment schedule and delivery responsibilities. Existing signed agreements continue to govern their engagements unless the parties agree a change.
1. Introduction
8Creatives FZE is a registered company legally based in Sharjah, UAE. We provide reserved-capacity Design Desks, project-based graphic design, website design and development, custom software solutions, and video and content production under an agreed scope.
These Terms form a binding agreement between you (“Client,” “you”) and 8Creatives FZE (“we,” “us,” “our”).
2. Service Scope
2.1 Deliverables
Design Desks reserve productive design capacity on scheduled working days: Execution Desk, 3 hours/day; Directed Desk, 4 hours/day; Dedicated Designer, 8 hours/day; Studio Pod, a team of two or more designers with capacity agreed in the scope. A consistent designer works through one prioritised queue. Execution includes coordination and quality checks; the Client supplies the concepts, copy and creative direction. Support roles may be shared or combined and do not represent additional full-time allocations. Execution Desk covers execution from clear briefs and established direction; new concepts and rollouts are available from Directed Desk.
2.2 Turnaround Time
Daily capacity is not a promise that every deliverable takes one day. Timing depends on task complexity, complete briefs and source material, dependencies and client feedback. Larger tasks can span several working days. Defined project milestones are agreed in the quotation.
2.3 Revisions
Revisions are handled within the reserved design capacity. For defined projects, revision rounds and changes to scope follow the accepted quotation. Consolidated feedback and timely approvals are required to keep work moving.
3. Working Days, Capacity & Client Inputs
We follow UAE working days and public holidays: Monday to Friday, excluding UAE public holidays. Capacity is reserved for scheduled working days. Unused hours do not carry over to another day or billing period. The Client supplies complete briefs, approved copy, brand assets and an ordered queue, and provides consolidated feedback and approvals. Project management and art direction are additional to the stated design hours on Directed Desk and the larger plans that include them.
4. Payments, Renewals & Cancellations
4.1 Engagement Models & Pricing
Design Desks are available on monthly, quarterly and annual terms. Current monthly rates are Execution Desk AED 3,199; Directed Desk AED 5,500; Dedicated Designer AED 7,800; Studio Pod from AED 10,000. Quarterly and annual rates are published on the pricing page as monthly equivalents for the corresponding term, with 7% quarterly and 12% annual discounts on Execution, Directed and Dedicated. Monthly plans are billed in advance. The payment schedule for a longer term is confirmed in the accepted proposal. Defined projects and specialist services are quoted separately.
4.2 Payment Method
Payments are processed securely through Stripe or an approved payment provider. All charges are in USD or AED unless otherwise agreed.
4.3 Billing Cycle & Due Date
For a monthly Design Desk, the billing cycle begins on the agreed start date and renews on the corresponding calendar date unless cancelled under the agreed terms. Quarterly and annual engagements follow the billing, renewal and change arrangements stated in their accepted proposal or service agreement.
4.4 Failed Payments & Grace Period
In the event of a failed payment, a 3 to 5-day grace period will be provided. If payment is not made within this period, your service may be paused until the issue is resolved.
4.5 Refund Policy
We do not offer refunds for partial months, unused time, or unused requests.
4.6 Cancellation
For a monthly plan, send a cancellation request by email at least 10 days before the next billing date. Cancellation stops future renewal and does not trigger a refund for the current period. Quarterly and annual term changes, cancellation and any pause arrangement follow the accepted service agreement; no automatic pause allowance is promised.
4.7 Reactivation
If you cancel and later choose to return, a reactivation fee may apply depending on your previous plan.
4.8 Service Suspension
We reserve the right to suspend or limit your service in cases of overdue payments, suspected misuse, or violations of these Terms. Service resumes once the issue is resolved.
4.9 Two-Week Paid Pilot
The AED 990 paid pilot is offered after a discovery call confirms fit and available capacity. It provides 3 productive design hours per scheduled working day for two weeks and one art-directed design the Client keeps. The normal queue, feedback, working-day, public-holiday and no-carry-over rules apply. The full AED 990 is credited to month one if an ongoing plan starts within 7 days. The discovery discussion confirms the pilot start and credit window.
5. Intellectual Property & Licensing
5.1 Ownership
Once the final deliverable is approved and full payment is received, the Client owns full rights to the work created.
5.2 Use of Stock Assets
We may use licensed stock images, videos, or fonts in your projects. These are subject to their original license terms and may not be sublicensed or resold.
6. Client Responsibilities
Creative Briefs: You are responsible for providing clear, complete instructions and brand assets.
Communication: Prompt feedback ensures timely delivery.
Compliance: You are responsible for ensuring that your content does not infringe on any rights or violate any laws.
7. Confidentiality
We will not share, reuse, or sell any proprietary information or materials you provide. Confidentiality is strictly maintained unless required by law.
8. Communication Channels
We use email and our internal project dashboard as primary communication tools. Response times may vary slightly depending on time zones, but we aim to reply within one business day.
9. Subcontracting
8Creatives FZE reserves the right to assign tasks to qualified team members or subcontractors. All work is reviewed to meet our standards.
10. Design Desk Exclusions & Separate Services
The following are not automatically included in reserved graphic-design hours:
– Website development, e-commerce implementation and custom software development: available as separately scoped projects
– Video shoots, podcast production and specialist motion work: separately scoped; podcast studio partner rates can be discussed alongside editing packages
– 3D design
– Copywriting or content strategy
Specialist scope, third-party costs and any additional charges must be agreed before the related work begins.
11. Limitation of Liability
Our maximum liability is limited to the amount paid in the most recent month of subscription. We are not liable for any indirect, incidental, or consequential damages.
12. Indemnification
You agree to indemnify and hold harmless 8Creatives FZE from any legal claims or disputes arising from content you supply or instructions you give.
13. Legal Terms
13.1 Dispute Resolution
In the event of a dispute, both parties agree to try to resolve it amicably through direct communication. If unresolved, the matter will proceed to mediation or arbitration in Sharjah, UAE.
13.2 Governing Law
These Terms are governed by the laws of the Emirate of Sharjah and the applicable federal laws of the United Arab Emirates.
13.3 Non-Solicitation
Clients agree not to solicit, hire, or directly contract with any 8Creatives FZE employee, contractor, or freelancer for 12 months following the end of their subscription.
13.4 Term & Termination
These Terms remain active as long as the Client maintains a subscription. Either party may terminate the agreement with cause if a material breach occurs and is not resolved within 15 days of written notice.
13.5 Severability
If any provision of these Terms is deemed invalid or unenforceable, the rest of the Terms shall remain fully effective.
13.6 Waiver
Any failure by 8Creatives FZE to enforce a provision of these Terms does not waive our right to enforce it later.
14. Updates to Terms
We may update these Terms from time to time. Changes will be communicated to active clients via email and posted on our website. Continued use of our service constitutes acceptance of the revised Terms.
